California Wrongful Death Law
Under California Code of Civil Procedure Section 377.60, a wrongful death claim arises when a person dies as a result of another party’s wrongful act or negligence. The law allows certain surviving family members to seek compensation for the losses they have suffered as a result of their loved one’s death.
California law distinguishes between a wrongful death claim — which compensates the surviving family — and a survival action under CCP 377.30, which recovers damages the deceased person experienced before death, including pain and suffering. Both types of claims can be pursued in the same case.
